In 2004 a new procedure for dealing with personal injuries claims was introduced in Ireland. This involved the setting up of a body known as the Personal Injuries Assessment Board or PIAB. If a person now wishes to make a personal injuries claim against another party they must apply to PIAB and we can assist you with this process. Although PIAB was set up to minimise the need for a Solicitor in such cases, the vast majority of claimants still seek the help of solicitors to ensure the claim is properly brought within the time allowed and against the correct parties.
Motor Accidents:
If you are involved in a motor accident it is very important that you take the following steps as they will assist you in any future claim which you may make:
1. Ensure that you take down the following details from the other parties involved:
Name and Address of Driver
Name and Address of Owner of the Vehicle, if different
Car Registration Number
Insurance Details (Insurance Company, Policy Number and Expiry Date)
2. Contact the Gardai
If an ambulance is required, then the Gardai will come to the scene of the accident to investigate.
If no-one appears to be seriously injured and no ambulance is required then the Gardai may not attend the scene. However, it is important that you still notify them of the basic details of the accident and that they keep a record of it.
If you are injured ensure that you attend your doctor or local hospital
Take the details of any witnesses to the accident
If you can, take photographs of the scene
Never admit liability at the scene of the accident
Accidents at Work:
Sustaining an injury at work can sometimes put an employee in an awkward position with regard to their employer. However, all employers have a duty to provide a safe place of work and systems of work for their employees and to ensure that their employees are adequately trained. If your employer has failed to do so and you are injured as a result you may be entitled to be compensated for this.
If you are involved in an accident at work, it is important that you ensure that the accident is reported to your employer immediately and that if you are injured you attend your doctor or local hospital.
